SMS TERMS & CONDITIONS

These SMS Terms & Conditions ("SMS Terms") govern text messaging services provided through the Covenant platform by GovernUp Solutions, LLC ("GovernUp," "we," "us"). These SMS Terms supplement our Terms of Use and Privacy Policy. By opting in to receive text messages from Covenant, you agree to these SMS Terms.

1. Program Description

Covenant provides two-way SMS messaging between community management teams and residents. The SMS program is used by homeowner associations (HOAs), condominium associations, and property management companies to communicate with their community residents. Messages are sent and received via the Covenant platform using Twilio as our messaging service provider.

SMS messages may include:

  • Community announcements and updates
  • Emergency and safety alerts
  • Maintenance and work order notifications
  • Violation notices and compliance updates
  • Meeting reminders and agenda notifications
  • Assessment and payment reminders
  • Two-way conversations with your community management team
  • Account verification and security alerts

2. Consent and Opt-In

By providing your mobile phone number during account registration or in your account settings and enabling SMS notifications, you expressly consent to receive text messages from the Covenant platform at the number provided. Consent is not a condition of purchasing any goods or services.

You may opt in to SMS messaging by:

  • Providing your phone number during account registration and enabling SMS notifications
  • Enabling SMS notifications in your account notification preferences
  • Texting your community's designated Covenant phone number to initiate a conversation

3. Message Frequency

Message frequency varies based on your community's activity and your notification preferences. You may receive multiple messages per week depending on announcements, alerts, and conversations initiated by your management team or by you. Recurring messages will continue until you opt out.

4. Message and Data Rates

Message and data rates may apply. Standard messaging rates from your mobile carrier apply to all messages sent and received. GovernUp does not charge a separate fee for SMS messages, but your carrier's standard text messaging and data rates will apply. Contact your wireless carrier for details about your messaging plan.

5. Opt-Out Instructions

You can opt out of receiving SMS messages at any time by:

  • Replying STOP: Text STOP to any message received from Covenant. You will receive a single confirmation message and no further messages will be sent.
  • Account Settings: Disable SMS notifications in your notification preferences within the Covenant platform.
  • Contacting Us: Email support@governupsolutions.com to request SMS opt-out.

Important Notice

Even after opting out of general SMS notifications, you may still receive emergency safety alerts if your community management team sends an emergency-priority communication. This is to ensure critical safety information reaches all residents. Emergency alerts are rare and only used for genuine safety concerns.

6. Help and Support

For help with SMS messaging:

  • Reply HELP: Text HELP to any Covenant message for assistance.
  • Email: Contact support@governupsolutions.com for SMS support.
  • In-App: Visit your notification preferences in the Covenant platform to manage SMS settings.

7. Message Recording and Privacy

All SMS messages sent to and from the Covenant platform are recorded and stored as part of your community's communication records. This includes:

  • Message content, sender phone number, and timestamps
  • Delivery status and read receipts (where available)
  • Thread history between you and your management team

Inbound messages you send to the Covenant platform number are visible to your community's management team for the purpose of responding to resident inquiries. SMS data is retained for up to 3 years for compliance purposes. For full details on how your data is handled, see our Privacy Policy.

8. Supported Carriers

SMS messaging is supported on all major U.S. carriers, including but not limited to AT&T, T-Mobile, Verizon, Sprint, U.S. Cellular, and their subsidiaries. Carrier support is not guaranteed, and some carriers may impose additional restrictions on messaging.

9. Disclaimer of Liability

  • GovernUp is not liable for delayed or undelivered messages caused by carrier network issues, device compatibility, or recipient device settings.
  • GovernUp is not responsible for charges incurred by your mobile carrier for sending or receiving text messages.
  • SMS messaging should not be relied upon as the sole method of receiving emergency communications. Always follow your local emergency services guidance.
  • T-Mobile is not liable for delayed or undelivered messages.

10. TCPA Compliance

GovernUp complies with the Telephone Consumer Protection Act (TCPA) and related regulations. We obtain express consent before sending SMS messages and honor all opt-out requests immediately. Community management teams using the Covenant platform are required to comply with TCPA regulations when sending SMS broadcasts, including:

  • Sending messages only to residents who have opted in to receive SMS notifications
  • Honoring STOP requests immediately
  • Limiting messages to legitimate community business purposes
  • Not sending messages outside reasonable hours except for genuine emergencies

11. Changes to SMS Terms

We may update these SMS Terms to reflect changes in our messaging practices, carrier requirements, or legal obligations. We will notify you of material changes via the platform or by SMS. Your continued use of SMS messaging after an update constitutes acceptance of the revised terms.
